Terms of Service

By engaging The Web Creature's services or using this website, you agree to be bound by these Terms of Service.

We provide web development, mobile app development, custom software development, AI solutions, and digital marketing services. The specific scope and pricing for each engagement is defined in a separate statement of work (SOW).

Upon full payment, the client owns the final work product. The Web Creature retains the right to display completed work in its portfolio unless otherwise agreed in writing. Third-party components used in a project remain under their original licences.

A deposit is required before work begins. Payments are made via milestones or monthly retainer as agreed. Invoices are due within 14 days of issue. Late payments accrue interest at 1.5% per month. Work is paused if payment is more than 30 days overdue.

Clients are responsible for providing timely feedback and approvals, supplying necessary content, assets, and credentials, and ensuring they own the rights to any materials provided to us. Clients must keep credentials confidential.

Both parties agree to keep confidential information private. This obligation survives termination of the engagement.

Our liability is capped at the fees paid for the specific service in question. We are not liable for indirect or consequential damages.

We provide services with reasonable skill and care, and deliverables will conform to the agreed specification. We do not warrant that services will be uninterrupted or error-free.

Either party may terminate an engagement with 30 days' written notice. Deliverables and credentials will be handed over within 14 days of termination.

These terms are governed by the laws of India, and disputes are subject to the exclusive jurisdiction of the courts of India.

We may update these terms from time to time. Active clients will be notified of material changes. Continued use of our services constitutes acceptance of the updated terms.
